The Challenge

Our client wanted to construct a large outbuilding measuring approximately 7m × 6m (42sqm) at the rear of their garden. The structure was designed to comply with Class E permitted development limits. However, part of the site falls within a flood risk area. The property has no planning history. The client needed formal confirmation from the council before committing to significant construction costs.

Class E — GPDO 2015

Class E permits buildings incidental to the enjoyment of the dwellinghouse subject to conditions including: (b) total area of ground covered by buildings within the curtilage must not exceed 50% of the total area of the curtilage; (e) maximum height of 4m for a dual-pitched roof or 3m for any other roof; (f) maximum eaves height of 2.5m.

Flood risk does not prevent permitted development, but we recommend positioning the structure outside the flood zone where possible.

Our Strategy

A Certificate of Lawful Development (CLD) was the appropriate formal route. The application demonstrates compliance with all Class E criteria. We advised positioning the outbuilding outside the flood risk area to minimise risk to the structure and its contents. Building regulations approval is also required separately.

The certificate provides formal council confirmation that the outbuilding is lawful permitted development, giving the client legal certainty before committing to construction costs. The CLD also protects the client’s position for future property transactions.
